And people wonder why I keep pushing for higher licensing standards for real estate licensees in Arizona.

I agree this would not pass muster with most lenders and violates lines 28 & 29 of the residential purchase contract in Arizona.

That makes it even more suspicious doesn’t it?

I was trying to give these guys the benefit of the doubt. I was thinking it might be possible that these cabinets were custom crafted by a friend after they moved in and they were going to put the originals back. Somehow it doesn’t sound likely though.

I’m also wondering if these folks have already bought another place and decided they like these cabinets better. They could end up walking and taking the cabinets.

A cursory records search shows that the owers (spelling intentional) had a Notice of Trustee Sale filed on this house ($1,000,000 loan), and another one filed on a Grayhawk condo.

I would say that if this is a standard listing, the seller can excludes whatever he wants, even fixtures (which I define as anything that takes tools to remove).
If it is a short or foreclosure, that’s a different story, as fixtures impact the value of the property.
